Copyright Guidelines for Reserves

Faculty is responsible for obtaining copyright permission and complying with copyright law for their reserve materials. Permission can be obtained online through the Copyright Clearance Center or by sending a letter (on official letterhead) along with a self-addressed, stamped envelope to the rights-holder of the copyrighted work in question.

The Gregg M. Sinclair Library follows the principles of the fair use doctrine of the copyright law of the United States, Title 17 of the United States Code, Section 107.

Title 17 USC, Section 107. Limitations on exclusive rights: Fair Use:

 

"Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified in that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include

 

1.the purpose and character of the use, including whether such use is of a commercial

    nature or is for nonprofit educational purposes;

2. the nature of the copyrighted work;

3. the amount and substantiality of the portion used in relation to the copyrighted work as

   a whole; and

4. the effect of the use upon the potential market for or value of the copyrighted work.


The Gregg M. Sinclair Library faculty and staff cannot provide interpretations of copyright laws.

Electronic* and Print Reserves:

The following may be placed on course reserve without copyright permission for one semester ONLY.   Faculty is responsible for obtaining copyright permission for repeated use.

  1. A chapter from a book
  2. An article from a periodical, scholarly journal, or newspaper
  3. A short story, short essay or short poem, whether published by itself or in a collective work
  4. A chart, graph, diagrams, drawing, cartoon, or picture from a book, periodical, scholarly journal, or newspaper
  5. If a document is available as electronic full text and the library’s license allows, a hyperlink to the text will be setup

The following may NOT be placed on course reserve without copyright permission:

  1.  A copy of the entire book
  2.  More than one chapter of a single book
  3.  More than one article from a single periodical or newspaper issue
  4.  More than one selection from an anthology or collection
  5.  More than one chart, graph, diagrams, drawing, cartoon, or picture from a book, periodical, scholarly journal, or newspaper

Materials not subject to the fair use doctrine:

  1. Instructor’s personal copies of books, journals
  2. Instructor’s personal exams/quizzes, lecture notes, handouts, homework solutions, or study guides
  3. University of Hawai’i at Manoa Library books

*Electronic files will be removed from the reserves system at the end of each semester and summer sessions, unless permission has been obtained to retain the digitized version of the material.

Media Reserves:

Following may be placed on course reserve without copyright permission for one semester ONLY.   Faculty is responsible for obtaining copyright permission for repeated use.

  1. Up to 10%, but no more than 30 seconds of a musical work
  2. Up to 10%, but no more than 3 minutes of a visual work

Materials not subject to the fair use doctrine:

  1. Media owned by Sinclair Library
  2. Media owned by the instructor (Personal Copy)
  3. Instructor’s own works

The following media may NOT be placed on course reserve without copyright permission:

  1. Media copied from off-air*, cable, commercial tapes, or DVD
  2. Streaming of an entire work
  3. Media on the internet

Disclaimer:

  1. Reserve materials not in compliance with copyright law will be removed from the reserve System
  2. The library will not mirror or link to videos that are illegally posted on the web
  3. The library staff maintains the right to refuse placement on reserves any materials it judges to be beyond the boundaries of fair use.
  4. The library reserves the right to change the copyright policy as necessary
